Current
Florida Burglary Statutes define Burglary as
entering a dwelling, a structure, or a conveyance with
the intent to commit an offense therein, unless the
premises are at the time open to the public or the
defendant is licensed or invited to enter, or

Surreptitiously, with the
intent to commit an offense therein;

After permission to remain therein has been
withdrawn, with the intent to commit an offense
therein; or
-
To commit or
attempt to commit a forcible felony.
In order to be
convicted of Burglary, the prosecution must show beyond a
reasonable doubt that the accused either committed a crime
or intended to commit a crime after entering the
dwelling, a structure, or a
conveyance.

The forms
of Criminal Burglary, which includes:

Burglary
in the Second Degree:
if in the course of
committing the offense, the offender does not make
an assault or battery and is not and does not become
armed with a dangerous weapon or explosive, and the
offender enters or remains in a dwelling, a
structure, or a conveyance. Burglary in the Second
Degree is punishable by up to
a
$10,000 fine, fifteen (15) years prison and/or
probation.

Burglary
in the First Degree:
Burglary is a
felony of the first degree, punishable by
imprisonment for a term of years not exceeding life
imprisonment if, in the course of committing the
offense, the offender makes an assault or battery
upon any person, or is or becomes armed within the
dwelling, structure, or conveyance, with explosives
or a dangerous weapon.
Burglary in the
First Degree is punishable by up to
a
prison term not to exceed life imprisonment.
