If an
individual is charged with simple assault, is a second
degree misdemeanor,
punishable by
up to
a $500 fine, sixty (60) days jail and/or 6 months probation.
Aggravated Assault may be charged if, in the course of the
alleged assault, the accused displayed or had in his or her
possession a deadly weapon without intent to kill, and/or
had intent to commit a felony crime. Aggravated assault is a
third degree felony that may be punishable by up to
$5,000 fine, five (5) years prison and/or probation.
