If the accused knew or had reasonable grounds to believe the structure was occupied by a human being at the time of the alleged act, he or she may be charged with arson in the first degree (felony). A first degree felony conviction for arson is punishable by up to $15,000 fine, thirty (30) years prison and/or probation.

Arson in the second degree (felony) may be charged if the act of arson occurs in a structure that is not occupied at the time of the act of arson, or the accused  did not have reasonable grounds to believe the structure was occupied. A second degree felony conviction for arson is punishable by up to a $10,000 fine, fifteen (15) years prison and/or probation.

According to Florida Statute 806.01, one who commits an criminal act of arson is Arson is defined as:

Any person who willfully and unlawfully, or while in the commission of any felony, by fire or explosion, damages or causes damage to any dwelling or structure, such as: jails, prisons, or detention centers; hospitals, nursing homes, or other health care facilities; department stores, office buildings, business establishments, churches, or educational institutions during normal hours of occupancy; or other similar structures.
